Children of James Alphio Rivet Sr. and Ruby Ellen Wallace

Research Notes:

     My knowledge of this family originated from an obituary for James' daughter, Constance (Connie) Jones. Her obituary stated that her mother was Abye Rivet. However, Abye would have been 15 at Connie's birth, 14 at conception... not impossible, but something to consider... An old phone directory listing indicates they were married at least by 1943, but this was as early as I could find of a relationship between James and Abye. Then the 1930 census reveals James' wife at that time was Ruby Rivet, age 30. Ruby would have been age 22 when Connie was born. This did seem to be more likely than age 15. By the 1940 census, James and Abye were married.

Onward to check the Texas Birth Index on Ancestry.com. Parents were not recorded on this index in 1925 and earlier (for Constance and Ralph). In 1926, the index shows James Jr.'s mother as Ruby Ellen Mallin, and Lester's mother as Ruby Ellen Wallace in 1931. I have assumed these are the same Ruby, given the same middle name. Most likely, "Mallin" is a bad misinterpretation of the hand-written name Wallace, but the original birth certificate should be reviewed to confirm that is the case. This evidence looks pretty good for Ruby to be the correct mother, so I have made that correction in my records and assumed Ruby to be the mother of all four children.

It appears that James and Ruby must have divorced, based on notes found on an Ancestry tree, probably between 1931 (birth of last known child) and 1940 (census); for now, I have no actual record of the divorce, but haven't searched very hard either, other than to discover that online divorce indexes don't appear to be available for Texas until 1968 or later.

MilitaryJames Alphio Rivet was inducted into the U.S. Army as a private during World War I, on 31 Aug 1917 at Beaumont, Jefferson County, TX. He was assigned to Company G, 5th Infantry until 15 Oct 1917, then to Company B, 143rd Infantry until his discharge.6 He shipped out from Newport News, VA 14 Jul 1918 on the British transport Peleus to Halifax, Nova Scotia,7 then departed Halifax for England 27 Jul 1918 on the S.S. Nagoya.8 From there, he was sent to France, where he participated in the Meuse-Argonne offensive.6 He returned from Brest, France to Boston, MA 31 May 1919 on the U.S.S. Finland.9 James received an honorable discharge 13 Jun 1919, with a final rank of Private First Class. He was approved to receive the Victory Medal in 1920.6
Census1920, sonAlphio Rivet (given age 23) was enumerated as a son of Prisca Rivet (given age 46) on the 1920 Census, living at Beaumont, Jefferson County, TX. He worked as a boilermaker at a shipyard.10
MarriageJames Alphio Rivet married first Ruby Ellen Wallace about 1922.11
Census1930James A. Rivet (given age 36) was enumerated as the head of a household on the 1930 census, living at 335 Prince Street at Beaumont, Jefferson County, TX. Also living in the house was his wife Ruby Rivet (given age 30), his son(s) Ralph L and James A, his daughter(s) Constance A. They owned their home, which was valued at $4,000. They had a radio set. They could read, write and speak English. James worked as a pipe fitter foreman for an oil refinery.11
MarriageJames Alphio Rivet Sr. married second Abye Birdie King probably between 1932 and 1940.12,13
Census1940James A Rivet (given age 45) was enumerated on the 1940 census as the head of a household, living at 1010 Sullivan at Beaumont, Jefferson County, TX. Also living with him was his wife, Abye Rivet (given age 33), his son(s) Ralph, James A and Lester, his daughter(s) Constance, his sister, Lola Martin. They owned their home, which was valued at $3,000. Abye had completed two years of high school, and kept house. James had a sixth grade education. During the week before the census was taken, he worked 36 hours as a Sub Foreman for Magnolia Oil Company, and earned $2,100 in 1939.12
DraftRegJames Alphio Rivet Sr. registered for the fourth draft for World War II on 27 Apr 1942. This registration was also known as the "old man's draft". At that time, his residence was at 4210 Sullivan in Beaumont, Jefferson County, TX. He gave the name of Mrs. James A. Rivet, at the same address, as someone who would always know his address. James was employed by Magnolia Petroleum Company in Beaumont. He was described as five feet ten inches tall and 150 pounds, with brown eyes, gray hair, and light complexion.3
ResidenceAccording to a city directory in 1943, James A Rivet and his wife, Abye, lived at 4210 Sullivan in Beaumont, Jefferson County, TX, with child Ralph L. Two younger children also lived with them (probably James Jr. and Lester). James was employed by the Magnolia Petroleum Company.14
ResidencePrior to his death in 1956, James Alphio Rivet Sr. lived in Vidor, Orange County, TX.1
DeathHe died at age 61 of extensive burns on 29 Oct 1956 at the Hotel Dieu Hospital in Beaumont, Jefferson County, TX. A flash fire occurred the week before, on October 22, 1956, at the Magnolia Petroleum Company refinery, where he worked as a Pipe Foreman. He had second and third degree burns over 50 percent of his body, and was in the hospital for 6 days before he died.1
BurialHe was buried at King Cemetery in Hartburg, Newton County, TX.1
